Dear Governor Christine Gregoire:

I have reviewed your “Proposed 2006 Budget & Policy Highlights” and read that you “stand by the requirement, starting with the Class of 2008, that they pass the 10th grade WASL” (p.13).  I have continued to demonstrate through public documents that the current WASL design is assessing the higher-order thinking processing system of students. This design is the conceptual framework of Robert Carkhuff. Carkhuff’s conceptual framework is structured to label children who are unable to higher-order think as the detractors; this classification is determined by the current WASL design. Washington State Government has adopted Carkhuff principles and concepts through enacted laws and policies.  These laws and policies ensure that public school children who are not able to higher-order think are denied a high school diploma, and through public documents and published books noted as being


The OSPI public document (The New Science of Possibilities) I reviewed stated the following about the physically sick:

"It is fearful to look inside itself because it has no soul, fearful to look outside itself to view the free things it must destroy…We can view the unhealthy personality in the curve it produces…We can see the protective posturing in static conditions: the personality curled 'in utero' to defend itself against stimulating experiences; withdrawn in flight to avoid the exposure of 'neuronal gaps' in its brainpower…They are like receding waters; they are secure only in their knowledge of the inevitability of their outcomes.  Indeed, they would rather have the security of knowing where they are going than the risks of uncertainty: the security of dying over the risks of living!"

The OSPI discusses in another public document (Human Possibilities) that the interdependent processors (Actualizers) “become ‘one’ with the phenomena and process virtually as if [they] were them.  In ‘Workforce XXI,’ our [Human Capital Development] candidates soon discover the exhilaration of ‘breakthrough’ thinking generated by interdependent processing.”  OSPI Cabinet member, Dr. Shirley McCune writes in a public document that “Science is the spiritual quest…the New 3Rs enable our learners to process creatively…In short, the work of these possibilities scientists will empower all of us—learners and workers, teachers and managers—to achieve 'equity and inequality' through relating, empowering, and freeing the phenomena—people, data, things—to which we are dedicated.”

An OSPI document (The New Science of Possibilities) discusses the phenomena as “God is the phenomena…we can only approach God when we ‘phenomenalize’ His Universes…He co-processes only with those of us who use His most precious gift—the intellect with which he has endowed us.”  I have enclosed pages 232-243 and 259 of OSPI public document entitled The New Science of Possibilities and OSPI purchase orders supporting that The New Science of Possibilities is indeed an OSPI public document.

In the public document, The New Science of Possibilities, pages 232-243, an exact account of how the Washington State Superintendent, Dr. Terry Bergeson implemented the conceptual framework of Robert Carkhuff in the public educational system to develop and culminate “Interdependent processing systems dedicated to generating the most powerful images of phenomenal information…the lower-order processing systems are initiated at the elementary levels, while the higher-order processing systems culminate at the secondary levels.”

Your public support to finance the current WASL design and related education reform endorses


Your continued denial to address the truth and suspected criminal activities of a Washington State executive branch member will eventually reflect upon your leadership and result in significant legal action against the State of Washington.

Please respond in writing to the concerns presented in this letter, the December 13, 2005, letter and enclosed documents.  I am also requesting to meet with you and your senior staff responsible for implementing your directives.

In your written response, please inform me in writing of the action you will be taking to protect the constitutional rights of Washington State citizens.  Under the Revised Code of Washington (RCW) 43.06.010 “the governor shall supervise the conduct of all executive and ministerial offices.”  It is your ministerial duty to supervise the conduct of Dr. Terry Bergeson and OSPI.  Under RCW 43.10.090 the attorney general shall investigate violations of the criminal laws within this state upon the written request of the governor.  Under RCW 9A.80.010 “a public servant is guilty of official misconduct if, with the intent to obtain a benefit or to deprive another person of a lawful right or privilege (a) He intentionally commits an unauthorized act under color of law; or (b) He intentionally refrains from performing a duty imposed upon him by law.” 

Because of the evidence demonstrating the Superintendent’s intent to deprive public school children of an education that is constitutionally mandated and provided in accordance with Article IX, Section 1 and 4, Article I Section 1, 3, 11 and 29, I am requesting the governor act upon her ministerial duties and protect the constitutional rights of public school children.  In performing your ministerial duties as governor, your actions must involve obedience to the instructions of the laws instead of discretion, judgment, or skill (Garner, 2001). 

More clearly, the Washington Assessment of Student Learning determines the level of a child’s human processing system, which distinguishes between conditioned responders and those who are phenomenal processors generating new and innovative ideas (see OSPI 1999 publication).

Carkhuff’s Applied Human Technology outlines the concepts adopted by the State of Washington to transform teaching and learning.  Carkhuff’s Applied Human Technology has been advanced with public funds and through public policies that are enforced by OSPI.  The Washington State government’s advancement of Applied Human Technology is no different then if Washington State adopted laws to advance the conceptual framework of L. Ron Hubbard and his Applied Scientology or any other Psychotherapy treatment that relates to spiritual cleansing and communion with God.

The OSPI public documents obtained under a public disclosure request discuss communion with God, the process to attain this communion, the spiritual rebirth achieved once a child reaches the level of interdependent processing, and the salvation of freedom that is received when reaching the higher-order processing level of interdependent processing.  The OSPI public documents discuss in detail the groups and individuals who are not able to commune with God or higher-order think.  The OSPI public documents discuss the spiritual essence of a person, the soul, and label certain groups of people as having no soul. 

Applied Human Technology (The New Science of Possibilities) is the worship of the mind and the ideas created from individual thought processes.  The State of Washington, through the work of Dr. Terry Bergeson, Dr. Shirley McCune and Dr. Andrew Griffin, has adopted the conceptual framework of Robert Carkhuff as public policy and is advancing Carkhuff’s religious teachings, beliefs and principles through the assessment process--the current design of the Washington Assessment of Student Learning and its related education reform.  The governor is the supervisor over all executive and ministerial offices; she must take immediate legal steps to stop the advancement of a religion throughout our public school system. She must take immediate legal steps to stop the misuse of public funds.   She must submit a written request to the attorney general to initiate a criminal investigation into the activities of the Superintendent and all other parties in violation of assigned duties by malfeasance, misfeasance or nonfeasance.

Please provide a written response within two weeks of receiving this letter and all supporting documents listed on Attachment A.  My letter is not written to convince you of the truth, I am informing you of the State Superintendent’s activities in order to assist you in performing your ministerial duties.

Article IX

SECTION 1 PREAMBLE. It is the paramount duty of the state to make ample provision for the education of all children residing within its borders, without distinction or preference on account of race, color, caste, or sex.

SECTION 4 SECTARIAN CONTROL OR INFLUENCE PROHIBITED. All schools maintained or supported wholly or in part by the public funds shall be forever free from sectarian control or influence.

Article I

SECTION 1 POLITICAL POWER. All political power is inherent in the people, and governments derive their just powers from the consent of the governed, and are established to protect and maintain individual rights.

SECTION 3 PERSONAL RIGHTS. No person shall be deprived of life, liberty, or property, without due process of law.

SECTION 11 RELIGIOUS FREEDOM. Absolute freedom of conscience in all matters of religious sentiment, belief and worship, shall be guaranteed to every individual, and no one shall be molested or disturbed in person or property on account of religion…

SECTION 29 CONSTITUTION MANDATORY. The provisions of this Constitution are mandatory, unless by express words they are declared to be otherwise.
